4th Amendment Victories!

we do win some!

Dear frank,

It’s been a great week for electronic privacy and the 4th Amendment!

In a decision issued yesterday, the Sixth Circuit Court of Appeals ruled that the government must have a search warrant before it can seize and search emails stored by third party email service providers. Closely tracking arguments made by EFF in our amicus brief, the court found that email users have the same reasonable expectation of privacy in their stored email as they do in their phone calls and postal mail.

And today, the Third Circuit Court of Appeals agreed with EFF and refused the government’s request to reconsider an earlier pro-privacy decision, which held that federal magistrates have the discretion to require the government to get a search warrant based on probable cause before obtaining cell phone location records. That decision, based on EFF’s briefing and oral argument as a friend of the court, has implications far beyond cell phone location privacy. It could apply to a broad range of communications records – including the content of your emails, your web search or browsing histories, as well as the location of your phone.

Re: cherotic sent you a video: “extremeelvis yt”

This has become a Christmas classic in my home.

I played it last year while a group of friends and I sat around drinking hot cocoa.
Please let da boyz know they’ve become a holiday crowd pleaser!
Paul

ah, Paul, you sick puppy! But yes, we make the best Xmas specials! That reminds me, on LUVER we are in the middle of our Xmas special! Right now every other song is a Xmas song and on Xmas week every song will be a Xmas song. We have the largest universal Xmas collection… All the classics, many rarities and novelties… And then there are the Songs that put the X in Xmas!
Speaking of Xmas… Our Xmas tradition is watching BADDER SANTA!
Da Boyz picked up next month’s performance flier from the xerox place we have used for decades and our Xmas card was at the desk as an example of their work.

The Atchleys at The Ivy Room, Wed., Dec. 15th – 9pm

The Ivy Room improv/experimental Hootenanny series presents:

*The Atchleys

*Dean Santomieri -voice- with special guests Michael Zelner -reeds- and Suki O’Kane -percussion

*Amar Chaudhary -electronics

Venue:
Kingman’s Ivy Room – 860 San Pablo, Albany, CA | 9pm | free

===========================

For their final performance of 2010, The Atchleys play in their proverbial backyard: Kingman’s Ivy Room on San Pablo Ave. at Solano in Albany. The scene is laid back East Bay: good vibes, reasonably priced drinks, and seating available in the bar or in the adjoining music lounge: No Cover Charge.

The Atchleys mix sound-cocktails of found and original lyrics, commercially available loops, custom distortion and classic chords, audio-files from their private collection; all along with live vocals and electronics for a unique twist, unless you prefer olives, in which case we will accommodate with volume.

cherotic sent you a video: “extremeelvis yt”

today we tried to put up a Xmas video of extreme Elvis and I singing Xmas Songs together. But we got the below automatic rejection for copyright infringement. Obviously ELVIS is an automatic trigger, even though there are many EXTREME ELVIS videos on YOUTUBE.

And speaking of Xmas video, and remembering that YOUTUBE took the video of me down, here is one of our Xmas classics that has been up on YOUTUBE for years [watched by over eight thousands], http://www.youtube.com/watch?v=stIWdLqLvrM. Well, it is piss your pants funny video of Da Boyz hanging /dangling out at the BLUE HOUSE waiting for Santa, if you get my drift. That stays up!

Hi Frank,
Thomas Ferranti commented on your note “another painting!”.

Thomas wrote: “VIEWERS: PLEASE click the picture. It will embiggen. Then, here on Firefox, my cursor changed to a magnifying glass. I clicked the picture with it and it got bigger still! Highly recommended! 😉 I love this one, Frank! I am happily surprised t see that you do computer art. How was this one made?”

I did it in COREL PAINT SHOP PRO PHOTO X2. I started from a high res photo. I mainly used “magic markers.”

RE: another painting!

Nice 🙂

Frank, do you model out of a picture, scan and “paint” ( with the PC of course ) or draw it youself and paint ( with the PC I guess finally ) ?

Anyways, it’s pretty “warm and relaxe” 🙂

Just curious ( and waking up on a cold minus 10 degrees Montréal morning )
