It’s been a great week for electronic privacy and the 4th Amendment!
In a decision issued yesterday, the Sixth Circuit Court of Appeals ruled that the government must have a search warrant before it can seize and search emails stored by third party email service providers. Closely tracking arguments made by EFF in our amicus brief, the court found that email users have the same reasonable expectation of privacy in their stored email as they do in their phone calls and postal mail.

That decision, based on EFF’s briefing and oral argument as a friend of the court, has implications far beyond cell phone location privacy. It could apply to a broad range of communications records – including the content of your emails, your web search or browsing histories, as well as the location of your phone.

today we tried to put up a Xmas video of extreme Elvis and I singing Xmas Songs together. But we got the below automatic rejection for copyright infringement. Obviously ELVIS is an automatic trigger, even though there are many EXTREME ELVIS videos on YOUTUBE.
And speaking of Xmas video, and remembering that YOUTUBE took the video of me down, here is one of our Xmas classics that has been up on YOUTUBE for years [watched by over eight thousands], http://www.youtube.com/watch?v=stIWdLqLvrM. Well, it is piss your pants funny video of Da Boyz hanging /dangling out at the BLUE HOUSE waiting for Santa, if you get my drift. That stays up!

on a similar note… I have always said the eroticism and nudity is not the real reason why people freak out about my work. YOUTUBE has been taking down [aka censoring] my videos for years. There are a lot of videos up that have as much, if not more, nudity and eroticism as mine. YOUTUBE won’t say why they took stuff down, won’t engage in dialog. So last week they took down [or rather we discovered that they had taken down] the part one of a three-part video that had been up for a couple of years. It is of a thirty minute performance I did at THE NOTE THEATER in Hollywood a few years back. Keep in mind that they only took the first part down and left the other two parts up. Basically the first part was me sitting nude on the stage singing with my live band and beckoning to the audience. Ok, the three nude girls came out the last minute of the first part. But things got HOT in the second part [which is STILL UP!]. And in the third part [STILL UP!] a lot of the audience members [including a hot babe who took her blouse off and writhed on my lap] got on stage to dance with me and the three nude girls [this was before I saw your performance!]!
Now my question is… Am I, a nude crip, too sexy by myself for YOUTUBE?!

Great news for those who care about free speech and fair
use online: the Senate Judiciary Committee won’t consider
the dangerously flawed “Combating Online Infringement and
Counterfeits Act” (COICA) bill until after the midterm
elections, at least. This is a real victory, and the
support from all of you who used EFF’s Action Center to
write to your Senators played a key role. Thanks as well to
the 87 Internet scientists and engineers whose open letter
to Congress reminded lawmakers what is at stake, and to all
the other voices that helped sound the alarm.

* Government Seeks Back Door Into All Our Communications
The New York Times reported this week on a federal
government plan to put government-mandated “back doors” in
all communications systems, including all encryption

* Thai Webmaster Arrested for Online Speech
Last Friday the director of popular alternative Thai news
portal Prachatai was arrested by the Thai government.
Chiranuch Premchaipoen — popularly known as Jiew — was
charged under the intermediary liability provisions of the
2007 Computer Crime Act and for defamation of the Thai
royal family. She faces a 32-year prison sentence.

The U.S. government has made two proposals this week that threaten online speech and privacy in radical new ways. Either one, if passed by Congress, will fundamentally rewrite the rules of the Internet. EFF is fighting hard for your rights and needs your help.
These proposals are the most frightening we’ve seen in a long time. The first is a bill called the “Combating Online Infringement and Counterfeits Act,” which would give the Justice Department new powers to censor websites accused of aiding “piracy.” The second is an Obama Administration proposal that would end online privacy as we know it by requiring all Internet communication service providers — from Facebook to Skype to your webmail provider — to rebuild their systems to give the government backdoor access to all of your private Internet communications.
EFF is battling these threats to Internet users’ privacy and freedom of speech, and we need your support. The panel was a lively discussion about censorship and self-censorship! Afterward at dinner I sat next to Bill Ivey, Chair of the NEA from 1998-2001. He nixed several grants, “In order to preserve the agency.” Maybe at the time this was the right decision.

well, that’s the common rationale that most censors use in his position… And it’s also the rationale that most use who sign loyalty Oaths [the “decency clause” is really a loyalty oath to the established order]. Such rationale allows censorship a mask
of reasonable airs which allow censorship and loyalty Oaths to take hold. The price is too high! Artists should be unreasonable, refusing to be the lap-dogs/pussies of the established order. The NEA was destroyed for individual subversive artists like me. When I got my NEA, it was based upon my past work. I could use the money anyway I want. If I had to hand over the control of the art to the NEA /government, I couldn’t /wouldn’t do that. So I find other ways to do the work. After all, ain’t that a part of the artist’s job?!
